Agreement to These Terms
These Terms of Service ("Terms") govern your access to and use of the PODMocks website, app, and related services (collectively, the "Service") provided by TigerStudios LLC ("PODMocks," "we," "us," "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and Account Responsibilities
- You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the Service.
- You are responsible for maintaining the confidentiality of your account and for all activity under it.
- You agree to provide accurate information and keep your account details current.
Service Overview
PODMocks provides AI-assisted tools to generate product mockups, images, and videos. Results can be unpredictable and may vary based on inputs and model behavior.
Your Content, Inputs, and Outputs
Ownership of Inputs
You retain ownership of the designs, images, and other materials you upload or submit ("Inputs"). You grant PODMocks a limited, non-exclusive license to host, store, process, and use Inputs solely to operate, improve, and deliver the Service.
Ownership of Outputs
As between you and PODMocks, you own the AI-generated results produced for you through the Service ("Outputs"). You may use Outputs for commercial purposes, subject to these Terms and applicable law.
No Resale of Raw Outputs
You may not sell, license, or distribute Outputs as standalone files, templates, or stock assets. Using Outputs in product listings, advertising, marketing, or other commercial materials is allowed.
Your Rights and Responsibilities
You represent and warrant that you own or have the necessary rights and permissions to use your Inputs and to create and use Outputs. Using trademarks or copyrighted material is permitted only if you have the legal right to do so (by ownership or valid license).
Prohibited and Unacceptable Use
You may not use the Service for anything illegal, harmful, or immoral. This includes, but is not limited to:
- Violating laws or regulations.
- Infringing intellectual property rights.
- Harassment, hate, exploitation, deception, or invasion of privacy.
- Uploading malware, scraping, abusing, or interfering with the Service.
Free Previews
We offer a limited number of free, watermarked preview generations (currently 5). Previews are for evaluation only and are not licensed for commercial use.
Subscriptions, Credits, and Payments
- Paid plans unlock watermark-free downloads and monthly credits.
- Credits are consumed per generation based on the Service flow.
- Monthly credits roll over automatically at the start of each billing cycle (up to 2x your monthly limit).
- Prepaid/top-up credits do not expire unless stated at purchase.
- Credits are not currency and are not redeemable for cash.
Payments are processed by Stripe. We do not store your full payment card details.
Cancellation and Refunds
You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period unless otherwise stated.
14-Day Money-Back Guarantee: If you are not satisfied, email podmockups@gmail.com within 14 days of your first paid subscription charge to request a refund. If a refund is granted, you agree to immediately stop using all Outputs and delete them from any listings, marketing, or other uses. Your license to those Outputs is revoked upon refund.
We reserve the right to refuse refunds in cases of heavy use, abuse, or violation of these Terms.
For purposes of the 14-day money-back guarantee, "heavy use" means consuming more than 40% of your included monthly credits or generating more than 25 watermark-free Outputs (including for plans that do not meter credits). Refund requests that meet or exceed these thresholds may be declined.
Third-Party Services
The Service integrates with third-party providers. Your use of these services may be subject to their separate terms and policies.
Feedback
If you provide feedback or suggestions, you grant us a non-exclusive, royalty-free license to use it without restriction or compensation.
Suspension and Termination
We may suspend or terminate access to the Service if you violate these Terms or if required by law. We may remove or disable access to content as needed.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT OUTPUTS WILL BE ERROR-FREE, ACCURATE, OR SUITABLE FOR ANY PARTICULAR USE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PODMOCKS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO PODMOCKS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify and hold harmless PODMocks and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the Service, your Inputs, or your violation of these Terms.
Dispute Resolution; Arbitration; Class Action Waiver
Most concerns can be resolved quickly. Before either party starts a formal dispute, you agree to contact us at podmockups@gmail.com and allow 30 days for an informal resolution.
Binding Arbitration
If a dispute is not resolved informally, any claim arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator has the authority to award the same damages and relief as a court. Judgment on the award may be entered in any court with jurisdiction.
Location and Procedure
Unless we agree otherwise, arbitration will take place in your county of residence (if in the United States) or Travis County, Texas. For claims of $10,000 or less, you may choose to have the arbitration conducted by telephone, video, or written submissions.
Small Claims Court
Either party may bring an individual action in small claims court if it qualifies and remains in small claims court.
Class Action Waiver
You and PODMocks agree that disputes will be brought only in your individual capacity and not as a plaintiff or class member in any class, collective, representative, or private attorney general action. The arbitrator may not consolidate claims or preside over any form of class proceeding.
Opt-Out
You may opt out of arbitration within 30 days of first accepting these Terms by emailing podmockups@gmail.com with the subject "Arbitration Opt-Out" and your name and account email address. If you opt out, disputes will be resolved in the courts described below.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provision above.
Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on this page with a new "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
